Is that your experience? The betas that I have participated in, from the largest
to the smallest companies have:
(1) never precluded mention that the NDA existed if there was one; and
(2) never precluded mention that the beta was `in process' at a minimum.
A few alphas have been quite restrictive, IME, but betas are generally so public
(public solicitation, as in this case) that it would be silly to have a super-restrictive
NDA, particularly when the existence of the product has been pre-announced and its
general description has been published, again, as in this case.
So, IME, you're quite wrong about whether it would be `unusual' or not.
